STANDARD NO. 101
PROBLEM:
When the current examiner discovers a defect sufficiently important to the current examiner that the current examiner considers refusing to certify the title, what steps, if any, should the current examiner take knowing the same title has been examined and approved by a prior examiner?
RECOMMENDATION:
The current examiner is encouraged to consult with the prior examiner to determine if the prior examiner has information not known to the current examiner which may be pertinent to the current examiner’s assessment of the defect.
