PROBLEM:
What items must be included in an abstract of a conveyance or mortgage?
RECOMMENDATION:
- Location of registry
- Book and page of record
- Type of instrument
- Date of execution
- Date of acknowledgment
- Date of recording
- Consideration
- Names of parties
- Marital recital; or release of dower or rights of descent
- Description (verbatim unless otherwise indicated, including title reference, if any)
- Signature of grantors
- Seals
- Unusual elements (e.g., estate created in granting and habendum clauses, restrictions, conditions, support mortgage proviso language, references to encumbrances, variances, covenants)
DISCUSSION:
In counties where an abstract is customarily not delivered in connection with the title opinion the examiner nevertheless will need to examine this material however informally put together.
